1. Acceptance of Terms
   By installing, accessing, or using MassMessenger (“the App”), you agree to these Terms & Conditions. If you do not agree, you must not use the App.

2. Permitted Use
   MassMessenger is intended solely for communications with known contacts and/or customers. By using the App, you agree to:

• Use it only for lawful purposes.

• Not send unsolicited bulk messages, spam, phishing content, scams, or any other prohibited communications.

• Comply with all applicable federal, state (including Utah), and international laws regarding messaging, privacy, and electronic communications.

1. Prohibited Uses
   You must not:

• Use the App for spam, phishing, scams, or any malicious or fraudulent activity.

• Send bulk or automated messages to recipients without their consent.

• Circumvent the App’s built-in sending limits (e.g., running multiple instances or exceeding the permitted message frequency).

Violation of these rules may result in your phone number or account being blocked by carriers, platforms, or third-party services.

1. Message Sending Limits
   To protect users and maintain compliance, the App is limited to sending one message every three (3) seconds per instance.

Running multiple instances or exceeding this limit significantly increases the risk of your number being blocked or restricted.

MassMessenger and its developers are not responsible for any account bans, phone number blocks, or delivery failures caused by misuse, excessive sending, or violation of these limits.

1. Data Privacy & Contact Information
   MassMessenger operates as a local instance on your device/system.

• We do not host, store, or access your contacts, messages, or other data.

• Because we have no access to your system or your App instance, we are not responsible for any contact leakage, data loss, or unauthorized access on your device.

1. User Responsibility
   You are solely responsible for:

• The content you send through the App.

• Compliance with anti-spam, privacy, and data protection laws in your jurisdiction.

• Securing your own system and protecting your contacts and data.

1. Licensing & Compatibility
   Your license to use MassMessenger covers the current version of the App only. Future operating system updates (including macOS) may render the App incompatible. We are not obligated to maintain or update the App to ensure future compatibility.

2. No Warranty
   MassMessenger is provided “as is” without any warranties, express or implied. We do not guarantee uninterrupted or error-free operation, or compatibility with future operating system updates.

3. Limitation of Liability
   To the maximum extent permitted by Utah law, MassMessenger and its developers shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to damages arising from:

• Misuse of the App.

• Blocking or banning of your phone number.

• Data loss or contact leakage from your system.

• App incompatibility due to operating system updates.

1. Indemnification
   You agree to indemnify, defend, and hold harmless MassMessenger, its developers, and affiliates from and against any claims, damages, liabilities, and expenses (including attorney’s fees) arising from your misuse of the App or violation of these Terms & Conditions.

2. Modifications
   We may update these Terms & Conditions at any time. Continued use of the App after updates constitutes your acceptance of the new terms.

3. Governing Law
   These Terms & Conditions are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

Privacy Policy

Effective Date: September 29, 2025

1. Local Data Storage
   MassMessenger operates entirely as a local instance on your device. We do not collect, store, or transmit your contacts, messages, or any personal data to our servers.

2. No Access to User Data
   Because we do not have access to your contacts or message content:

• We cannot retrieve lost data.

• We cannot be held responsible for contact leakage or unauthorized access on your device.

1. Limited Information Collected
   We may collect minimal, non-identifiable information strictly necessary for licensing verification (e.g., license key validity). No personal contacts or message contents are ever collected.

2. Third-Party Services
   If you use third-party messaging platforms or carriers with MassMessenger, their privacy policies and terms apply separately. We are not responsible for the actions of those third parties.

3. Data Security
   You are solely responsible for securing your device and safeguarding your data, including the contacts and messages you process through the App.

4. Changes to This Policy
   We may update this Privacy Policy at any time. Your continued use of MassMessenger after updates constitutes your acceptance of the revised policy.
